Ordinary Residence Permit in Malta

Ordinary Residence Permit in Malta is aimed at EU/EEA/Swiss nationals who intend to reside in Malta for a period longer than three months. Likewise, individuals are obliged to register and apply for a residence permit (e-Residence card) if they intend to stay in Malta. There are various grounds upon which an applicant may apply to require a residence permit, including:

  • Self-Sufficiency: EU/EEA/Swiss nationals may apply for residence in Malta on the basis that they are economically self-sufficient by proving adequate supporting documentation that they are able to support their lifestyle without the need to work in Malta either because they have significant savings or they are in receipt of some form of income. For an individual applicant, self-sufficiency is obtained proven by providing a personal bank statement containing a minimum of EUR 15,000 therein while in the event of a family, self-sufficiency is obtained at EUR 25,000. An applicant would also require to take out a private health insurance to cover in the event of any health care requirements in Malta.
  • Employment or Self-Employment: EU/EEA/Swiss nationals can apply for ordinary residence on the basis that such individuals work in Malta or are otherwise self-employed and carrying out their trade or profession in Malta.   • Family Members: EU/EEA/Swiss nationals who are family members of a person who is authorized to legally reside in Malta may accompany the main applicant throughout their stay in Malta provided that they prove that they are financially dependent on the latter.

Malta Retirement Programme (MRP)

The Malta Retirement Programme Rules provides for a Malta Special Tax Status which can be availed of by all EU/EEA/Swiss individual pensioners. The Malta Retirement Programme rules entitle successful applicants to a Special Tax Status provided they comply with a number of criteria listed hereunder:

  • All foreign sourced income (pension included) which is remitted to Malta shall be taxable at a favourable flat rate of 15%, with the possibility of claiming double tax relief on such income subject to a minimum tax of €7,500 annually;
  • Is in receipt of a pension, as supported by documentary evidence, all of which is received in Malta and constitutes at least 75% of his chargeable income;
  • A beneficiary with dependents must pay an additional €500 per year for every dependent and every special carer;
  • Any other chargeable income received by the beneficiary will be charged to tax at a flat rate of 35%;
  • The beneficiary must not reside in any other jurisdiction for more than 183 days;
  • The beneficiary must rent or purchase property in Malta

Beneficiaries under the Malta Retirement Programme will be issued with a residence permit authorising them to reside in Malta for the length of their tax residence.

The Residence Programme Rules

“The Residence Programme (TRP)” is a programme designed to attract individuals who are nationals of the EU, EEA or Switzerland and who are not permanent residents of Malta. Beneficiaries may also have household staff providing a service in their qualifying property, as long as all the requisite procedures are satisfied.

Subject to satisfying the requirements of the programme, beneficiaries under the Residence Programme will be issued with a residence permit and entitled to a special status by the Malta International Tax Unit (ITU) whereby income generated overseas, but remitted to Malta will be taxed at a fixed rate of 15%.

Malta Nomad Residence Permit

The Nomad Residence Permit enables holders to retain their current employment based in another country whilst legally residing in Malta. The Permit is open to individuals who can work remotely and independent of location, using telecommunications technologies. A successful main applicant may also include their eligible family members in their Nomad Residence Permit application and thereby the entire family may efficiently benefit from the right to live in Malta whilst enjoying visa-free Schengen travel for 90 days out of every 180 days.

The permit will be issued for one year and can be renewed upon application at the discretion of Residency Malta, as long as the applicant still meets the set eligibility criteria. The card may be renewed twice for a global total maximum stay of 3 years.

At a glance, the main requirements under the programme are the following:

  • The applicant must be a third country national who is 18 or over;
  • Must be employed/self-employed or freelance and must have the technological ability to work remotely;
  • The employment must carry a minimum gross yearly income of EUR 32,400;
  • Proof of accommodation in Malta for the duration of the programme;
  • Proof of health insurance cover for the main applicant and any family members for the duration of the programme.
